These Terms of Service ("Terms") govern your use of the somlengstudio.com website (the "Site") and the Somleng Studio for Mac application (the "App"), both operated by KhmerLife Records ("Somleng Studio", "we", "us"). Please read them carefully.

1. Acceptance

By accessing the Site or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or the App.

2. Use of the Site

You may browse the Site, play music through the embedded players, and follow links to streaming platforms for your personal, non-commercial enjoyment. You agree not to:

• scrape, crawl, or bulk-download content from the Site, other than through standard search-engine indexing;
• attempt to access the admin area or any non-public part of the Site;
• interfere with the Site's security or availability; or
• use the Site in any way that violates applicable law.

3. Use of the App

The App is provided to help manage YouTube channels through YouTube API Services. By using the App you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy, in addition to these Terms. You are responsible for the content you upload or modify on YouTube through the App and for complying with YouTube's Community Guidelines and copyright rules. We may update, limit, or discontinue the App at any time.

4. Intellectual property

All music, lyrics, cover art, videos, logos, and other creative works published by Somleng Studio are owned by KhmerLife Records and protected by copyright and trademark law. "Somleng Studio" and the Somleng Studio logo are trademarks of KhmerLife Records.

You may share links to our songs and embed our YouTube videos using YouTube's official embed feature. You may not download, re-upload, remix, sample, sell, or otherwise redistribute our music or artwork without written permission. For licensing requests, including sync and commercial use, contact hello@somlengstudio.com.

5. AI-generated content disclosure

Somleng Studio's music and much of its artwork are created with the assistance of generative AI tools, directed, curated, and edited by our team. Vocals, performances, and artwork may not correspond to any real person; any resemblance is coincidental. We label our work as AI-assisted on the platforms where we publish it, and we ask that you keep that attribution when you share it.

6. Third-party services

The Site links to and embeds services operated by others, including YouTube, Spotify, Apple Music, DistroKid, and social networks. We do not control those services and are not responsible for their content, availability, or terms.

7. Disclaimers

The Site and the App are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site or the App will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, KhmerLife Records and its owners, contributors, and collaborators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of your use of the Site or the App. Our total liability for any claim relating to the Site or the App will not exceed one hundred US dollars (US$100).

9. Indemnification

You agree to indemnify and hold harmless KhmerLife Records from any claims, damages, or expenses arising from your misuse of the Site or the App or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [COUNTY, e.g. Los Angeles County], California, and you consent to their jurisdiction.
